1. TERMS OF USE OF MitoArt GALLERY

1.1. Viewing the mitoart.bg gallery is completely free and accessible from anywhere in the world.

1.2. In order to shop from the gallery, the User is not required to register and provide personal data. At the explicit request of the User, he can register.

1.3. In the gallery (www.mitoart.bg) for each painting that is available for sale, the price, the main characteristics and additional information are indicated, aimed at helping to make an informed choice when purchasing the given work of art.

1.4. All prices indicated on the website are final.

1.5. On the right side of the page below each painting available for sale is a "Buy" button. Pressing the "Buy" button saves the selected product in the User's virtual basket. The contents of the basket are saved until the User decides to proceed with the purchase of the selected items (artwork). By pressing the "Products" button (in the upper right corner of the site), the user can browse the contents of his virtual collection, add new pictures or remove those he does not want. After pressing the "Pay" button, the customer's data (if registered on the site), delivery data and a re-view of the virtual collection appear.

2. ORDER OF ART WORKS

2.1. To place an order with MitoArt Gallery, the User must specify:

2.1.1. a valid email address;

2.1.2. correctly filled in delivery and billing address;

2.1.3. correctly filled in contact details – two names, phone.

2.1.4. highlighting the "Terms and Conditions" and "Privacy Policy" buttons

2.2. The order is activated, i.e. apply to the gallery by pressing the second button "Payment" - located after the delivery data and payment method of the order.

2.3.. Upon successfully placing an order, the User receives confirmation of the order by e-mail to the e-mail address specified by him. The email confirmation states the painting (artwork) ordered, the order number, the date and time the order was placed. Confirmation by phone is carried out for the first order or if additional information or clarification regarding the order or delivery is needed.

2.3.1. In the event that the ordered painting (artwork) is not available, the gallerist shall notify the User. If the User does not agree to the order being referred to another picture (artwork), the order may be cancelled.

2.3.2. Orders in the online gallery www.mitoart.bg are accepted 24 hours a day, 7 days a week.

2.3.3. Orders received without correct data of the buyer (User) or missing data are canceled if the Seller does not receive the correct data within 48 hours after the order is placed. Such orders are given the status "CANCELED" due to the impossibility of being fulfilled.

2.3.4. The user can refuse an order placed without having to mention reasons for the refusal.

2.3.5. Cancellation of an order can be made by phone or by e-mail to the e-mail address specified on the website - e-mail: mpunev@gmail.com

3. DELIVERY OF ORDERED artwork

3.1. After an order is received by a User at www.mitoart.bg, the gallery's automated system notifies the User by email about the successfully accepted order.

3.2. Delivery is made only on successfully accepted orders. When packing the ordered painting (artwork), the user is notified by email that the painting (artwork) is being handed over to a courier for transport to the respective address.

3.3. The delivery of an ordered painting (artwork) is not carried out on Sundays and public holidays, except under individually agreed conditions.

3.3.1. Orders are delivered within 3-5 working days, but in rare cases a delay is possible, which will be specified when the order is confirmed.

3.4. The seller uses the courier company Speedy or Econt Express for deliveries (upon the customer's prior request in the order panel), and in certain cases the delivery is carried out by a gallerist.

3.5. The delivery is made to the exact address specified by the User or to the office of the courier company in the relevant city.

3.6. Delivery of all orders is at the expense of the User.

3.7. Every shipment is insured.

3.8. If the User does not provide access and conditions for delivery of the painting (work of art) to the specified address within the specified time or does not go to the specified office of the courier company to receive the painting (work of art) in time, if he has chosen this option, the Seller exempts from the obligation to perform the requested delivery.

4. PAYMENT

4.1. Payment for the ordered painting (artwork) can be done in two separate ways, regardless of the chosen payment method, the payment amount is the same and no additional payment processing fees are charged.

4.1.1. With "cash on delivery" - payment in cash to the courier upon delivery;

4.1.2. In cash if the delivery is made by the gallerist;

4.2. For each picture (artwork) ordered, the user must pay the price that is announced in the e-shop at the time of the order.

5. WAIVER OF AGREEMENT. COMPLAINT

5.1. The user has the right to claim or return a picture (artwork) purchased from the gallery immediately upon receiving the picture (artwork) if the picture (artwork) does not correspond to the image on the site.

5.2. Cancellation of the contract can also be made to the courier upon delivery of the painting (artwork).

5.3. In case of cancellation of the contract, the User is obliged to return the purchased picture (artwork) in an undamaged form and with preserved integrity.

5.4. Upon cancellation of the contract, if the User has paid for the goods, the amount paid for the returned painting (work of art) will be refunded to the bank account specified by him within 45 /forty-five/ days after the return of the painting (artwork). Amounts are not refunded until the User returns the painting (artwork). If the latter is not returned within the period under item 6.1, the withdrawal from the contract has no effect.

5.5. A complaint is made when the purchased painting (artwork) does not correspond to what was agreed between the parties to the sales contract. The discrepancy in what was agreed between the parties can be expressed in:

- damaged integrity of the picture (the work of art);

- the wrong picture (artwork) was sent, different from the one ordered;

- discrepancy with the description of the picture (the work of art);

- damage to the painting (the work of art) during transportation.

5.6. If the painting is framed, the frame is not subject to this contract and does not form part of the purchased painting. In this sense, the Gallery is not responsible for transport or other frame defects.

5.7. The complaint can be submitted to MitoArt at the indicated email address mpunev@gmail.com, and at the same time the User must return a picture (artwork).

5.8. In the event of a complaint, the User may choose to replace the specific painting (artwork) with another one upon equalization of prices - either the User pays extra if the other painting (artwork) is more expensive, or the User is reimbursed the difference between the replaced and the new painting (work of art) if the price of the new painting is lower than the price paid by the User.

5.9. The return of a painting (work of art) in the event of a claim, in cases other than damage during transport, is carried out under the following conditions:

- Preserved good artistic appearance (the picture is not torn, scratched, stained, damaged) and is at the expense of the User.

5.10. When replacing works of art, the transport costs are at the expense of the User in both directions, unless the replacement is due to the fault of the gallery.
